Welcome to Peen ("App"), operated by Harvest Idea Co., Ltd ("Company," "we," "our," or "us").

By accessing or using Peen, you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree, you must not use the App.

If you are under 20 years old (the age of majority under Thai law), you confirm that you have consent from a parent or legal guardian.

2. Description of Service

Peen provides:

• Rock climbing route information and topos
• Route grades and descriptions
• Photos and climbing area details
• User-submitted comments and updates
• Mapping and geolocation features

Peen is an informational platform only and does not provide professional instruction, safety certification, or inspection services.

3. Assumption of Risk & Safety Disclaimer

Rock climbing and outdoor activities are inherently dangerous and may result in serious injury, permanent disability, or death.

By using Peen, you acknowledge and agree:

• Route information may be inaccurate, outdated, incomplete, or incorrect.
• Bolt conditions, anchors, protection placements, and rock quality may change over time.
• Weather, erosion, loose rock, wildlife, or other hazards may not be reflected in the App.
• Climbing grades are subjective.
• GPS and mapping data may be inaccurate.
• Access permissions may change without notice.

You assume full responsibility for:

• Inspecting all anchors, bolts, and protection.
• Evaluating your own skill level and physical condition.
• Confirming land ownership and access legality.
• Using proper equipment and safety procedures.

Use of Peen is entirely at your own risk.

Harvest Idea Co., Ltd is not responsible for any injury, death, loss, or damage arising from climbing activities or reliance on App content.

4. No Professional Advice

Content provided in Peen does not constitute:

• Professional climbing instruction
• Engineering or safety inspection advice
• Land access authorization
• Legal advice

Always consult qualified professionals where appropriate.

5. User-Generated Content

Peen may allow users to submit:

• Route descriptions
• Photos
• Grades
• Comments
• Access information

By submitting content, you:

• Grant Harvest Idea Co., Ltd a worldwide, non-exclusive, royalty-free, perpetual license to use, modify, reproduce, distribute, and display such content.
• Represent that you own or have necessary rights to the content.
• Agree not to submit unlawful, misleading, defamatory, infringing, or unsafe content.

We reserve the right to remove or modify user content at our sole discretion.

6. Intellectual Property

All software, branding, design, databases, and content within Peen (excluding user-submitted content) are owned by Harvest Idea Co., Ltd or its licensors.

You may not:

• Copy, scrape, reproduce, or redistribute the climbing database.
• Use data to create competing services.
• Reverse engineer the App.
• Create derivative topo databases without written permission.

7. Mapping & Third-Party Services

Peen may use third-party mapping services.

We do not guarantee:

• Accuracy of maps or GPS coordinates.
• Continuous availability of third-party services.
• Real-time updates of closures or hazards.

Third-party services may be governed by their own terms and policies.

8. Access & Legal Compliance

Peen does not guarantee that:

• Access to climbing areas is lawful.
• Private land permissions exist.
• Seasonal closures or environmental restrictions are current.

Users are responsible for complying with:

• Thai laws and regulations.
• Local environmental protection laws.
• Private land access requirements.
• International regulations when using the App outside Thailand.

9. Limitation of Liability

To the maximum extent permitted under Thai law:

Harvest Idea Co., Ltd, its directors, employees, and affiliates shall not be liable for:

• Personal injury or death.
• Property damage.
• Equipment loss.
• Indirect, incidental, or consequential damages.
• Data loss or business interruption.

If liability cannot be excluded under applicable law, total liability shall not exceed the amount paid by you (if any) in the preceding 12 months.

10. Indemnification

You agree to indemnify and hold harmless Harvest Idea Co., Ltd from any claims, damages, losses, or legal costs arising from:

• Your climbing activities.
• Your use or misuse of Peen.
• Your violation of these Terms.
• Content you submit.

11. Accounts

If Peen provides account registration:

• You are responsible for maintaining account confidentiality.
• You are responsible for all activity under your account.
• We may suspend or terminate accounts that violate these Terms.

12. Subscriptions & Payments (If Applicable)

If Peen offers paid subscriptions:

• Fees are non-refundable except where required by law.
• Subscriptions may auto-renew unless canceled.
• You are responsible for applicable taxes.

13. Termination

We may suspend or terminate access if you:

• Violate these Terms.
• Use the App unlawfully.
• Harm the community or platform integrity.

You may stop using Peen at any time.

14. Privacy

Your use of Peen is also governed by our Privacy Policy, which complies with Thailand's Personal Data Protection Act (PDPA).

15. Changes to Terms

We may update these Terms at any time.

Continued use of the App after changes constitutes acceptance.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the Kingdom of Thailand.

Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangkok, Thailand.
